Dropped W.Va. lawsuit cost county $5K

Defending an abortive lawsuit filed by a county commissioner cost Marion County taxpayers about $5,000.

In September, Commissioner Wayne Stutler filed suit against his two fellow commissioners, saying they had overstepped their authority by removing a member of the county health board and by postponing a smoking ban.

Stutler dropped that suit, saying he didn’t want tax dollars spent on the litigation.

Commission President Randy Elliott says the final invoice has not been submitted, but even the initial phase of defending the lawsuit cost taxpayers about $5,000.

Stutler wouldn’t say how much he spent in filing the lawsuit.
